The EU AI Act entered its enforcement phase in 2026, and for the first time, the regulatory framework for AI use in Europe carries real compliance requirements and real penalties. For businesses operating in the EU — or selling to EU customers — understanding what the Act requires is no longer optional.
The Risk-Based Framework
The EU AI Act organizes AI systems into four risk categories. Your obligations depend entirely on which category applies to your use.
Prohibited AI (Banned)
Social scoring systems, real-time biometric surveillance in public spaces, and systems exploiting psychological vulnerabilities. Immediate cessation required if your business uses any of these.
High-Risk AI (Strict Requirements)
AI used in hiring, credit assessment, educational admissions, and some customer service applications in regulated industries. Requirements: risk assessment documentation, human oversight mechanisms, accuracy testing, and EU database registration before deployment.
Limited Risk (Transparency Only)
AI chatbots and content generation tools. Primary requirement: users must be informed they are interacting with an AI system. This is disclosure, not capability restriction.
Minimal Risk (No Requirements)
AI spam filters, recommendation systems, and most productivity AI tools. No mandatory compliance actions.
Practical Steps for Most Businesses
- Audit every AI system you use and how it’s used
- Classify each use case by risk category
- Request compliance documentation from AI tool vendors
- Add clear AI disclosure anywhere you use chatbots or AI content
- Document oversight processes for any HR-related AI use
The Penalties
Prohibited AI violations: up to €35 million or 7% of global annual turnover. High-risk violations: up to €15 million or 3% of turnover. For most businesses, the reputational risk of enforcement exceeds the financial penalty.
The Opportunity
Every compliance requirement creates a consulting opportunity. AI compliance advisory for EU businesses is a service category with growing, non-discretionary demand.
